Terms of Service
These Terms of Service apply to orders, products and services supplied by Aus Wide Sportswear. By placing an order with us, approving a quote or design, or using our website, you agree to these terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
1. Custom Sportswear and Teamwear
Aus Wide Sportswear supplies custom sportswear, teamwear and related apparel for clubs, schools, teams, businesses, organisations and other customers.
Many of our products are manufactured specifically for each customer according to approved designs, colours, sizing, quantities, logos, names, numbers, sponsor details and other specifications.
Because these products are custom-made, customers should carefully review all details before providing final approval.
2. Quotes
Quotes are prepared based on the information provided to Aus Wide Sportswear at the time of the enquiry.
A quote may take into account factors including:

garment type and specifications;

quantity;
-
decoration and customisation;
-
artwork requirements;
-
sizing;
-
delivery requirements; and
-
other agreed order requirements.
If the order requirements change after a quote is issued, the price or estimated timeframe may also change.
Any applicable freight, taxes or additional charges will be identified where reasonably practicable as part of the quote or order confirmation.
3. Minimum Order Quantity
Unless otherwise agreed by Aus Wide Sportswear in writing, our standard minimum order quantity is 10 pieces.
Mixed sizing is available within the minimum order where applicable to the product being ordered.
Any different minimum quantity applicable to a particular product or reorder will be communicated before the order is confirmed.
4. Artwork and Design Approval
Custom orders will not proceed to production until the required design and order details have been approved.
Customers are responsible for carefully reviewing all applicable:

artwork;
-
garment designs;
-
colours;
-
logos;
-
sponsor details;
-
names;
-
numbers;
-
spelling;
-
sizing;
-
quantities;
-
garment styles; and
-
other specifications.
Approval confirms that the customer accepts the submitted design and order specifications for production.
Changes requested after final approval may not be possible once production has commenced and may result in additional charges or delays where changes can still be accommodated.
5. Customer-Supplied Artwork, Logos and Intellectual Property
Customers are responsible for ensuring they have permission or authority to use any logos, trademarks, names, artwork, sponsor branding, images or other intellectual property supplied to Aus Wide Sportswear.
By providing these materials, the customer represents that Aus Wide Sportswear is authorised to reproduce them for the purpose of designing and producing the customer's order.
Aus Wide Sportswear may refuse to reproduce material where we reasonably believe its use may infringe another person's rights or otherwise be unlawful.
6. Colours and Product Appearance
We aim to reproduce approved designs and colours as accurately as reasonably possible.
However, colours displayed on phones, monitors and other digital screens may vary from the appearance of colours on finished fabric.
Reasonable variation may also occur between different fabrics, garment constructions, printing processes, production batches and decoration methods.
Where precise colour matching is important, please discuss this with us before final approval.
Nothing in this section limits rights available under the Australian Consumer Law.
7. Sizing
Customers are responsible for reviewing the applicable Aus Wide Sportswear size guide and confirming required sizes before production.
Where sizing information or garment measurements are provided, customers should use those measurements when selecting sizes rather than relying solely on the size label they normally wear from another brand.
Custom-made garments produced in accordance with the customer's approved sizes generally cannot be exchanged solely because an incorrect size was selected.
This does not affect your rights where goods fail to meet an applicable consumer guarantee.
8. Payment Terms
Once the final design, quote and order specifications have been approved, a 50% deposit is required before production can commence.
Production will not commence until:

final design approval has been provided;
-
required order specifications have been confirmed; and
-
the 50% deposit has been received.
The remaining 50% balance must be paid before the completed order is dispatched, unless alternative payment arrangements have been agreed by Aus Wide Sportswear in writing.
Delays in receiving approvals, information or payment may affect estimated production and delivery timeframes.
9. Production Timeframes
Production timeframes may vary depending on the products ordered, quantities, customisation requirements, production capacity and time of year.
Any production or delivery timeframe provided is an estimate unless expressly agreed otherwise in writing.
The estimated production timeframe will generally begin after all required approvals, order information and the required deposit have been received.
We will communicate with customers regarding material changes to an estimated timeframe where reasonably practicable.
10. Changes and Cancellations
Please contact Aus Wide Sportswear as soon as possible if you need to change or cancel an order.
Before production commences, we will assess whether the requested change or cancellation can reasonably be accommodated.
Once production has commenced, custom orders may not be able to be changed or cancelled because materials, printing, decoration or manufacturing may already have commenced specifically for that customer.
Any costs already reasonably incurred in connection with an approved custom order may be taken into account where permitted by law.
Nothing in this section limits rights or remedies available under the Australian Consumer Law.
11. Delivery
Customers are responsible for providing complete and accurate delivery information.
Delivery timeframes are estimates and may be affected by freight carriers and circumstances outside Aus Wide Sportswear's reasonable control.
Customers should notify us promptly if an order has not arrived as expected or appears to have been lost or damaged during delivery.

12. Faulty, Damaged or Incorrect Products
Customers should inspect their order promptly after delivery.
If you believe an item is faulty, damaged, incorrectly manufactured or different from the approved order, contact us as soon as possible at:

Where goods fail to meet an applicable consumer guarantee, the customer may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and as required by Australian Consumer Law.
13. Returns and Refunds
Returns and refunds are governed by our Returns & Refunds Policy.
Custom-made and personalised products generally cannot be returned for change of mind, incorrect size selection or changes requested after approval.
This does not affect rights or remedies available under the Australian Consumer Law.
14. Website Information
We make reasonable efforts to keep information on the Aus Wide Sportswear website accurate and current.
Product specifications, availability, colours, images, pricing and other information may change from time to time.
Where information on the website differs from specifications expressly agreed in a customer's confirmed quote or order, the confirmed order documentation will apply to the extent permitted by law.
15. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law where those guarantees apply.
Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
16. Governing Law
These Terms are governed by the laws applicable in New South Wales, Australia.
Nothing in this provision limits any rights a consumer may have under applicable Australian law.
